General Terms and Conditions of the odtahomat.cz Portal

These General Terms and Conditions (hereinafter "GTC") govern the rights and obligations between the portal provider, transporters, and end customers.

Valid and effective as of 6 June 2026.

1. Introductory Provisions and Definitions
  • 1.1. Provider: Assistance Solutions s.r.o., ID (IČO): 24941778, with registered office at Příčná 1892/4, 110 00 Prague 1, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, File No. C 445391, contact email: info@odtahomat.cz (hereinafter "Provider").
  • 1.2. Portal: The web platform and information system operated on the domain odtahomat.cz.
  • 1.3. Customer: A natural or legal person who requests vehicle transport through the Portal.
  • 1.4. Transporter: A legal entity or a self-employed professional possessing a valid license for road motor transport and cargo insurance, offering spare capacity for vehicle transport.
  • 1.5. Service: The intermediation of contact between the Customer and the Transporter through the Portal and Dispatch for the purpose of concluding a Contract for Transport.
2. Legal Nature of the Service
  • 2.1. The Provider is neither a carrier nor a freight forwarder within the meaning of Act No. 89/2012 Coll., the Civil Code.
  • 2.2. The Portal serves exclusively as a technological tool for matching supply and demand. The Contract for the Carriage of Goods arises exclusively and directly between the Customer and the Transporter. The Provider is not a party to this contract and bears no liability for its fulfillment.
  • 2.3. The Portal's Dispatch acts as communication support to facilitate the conclusion of the transaction, not as a controlling body of the transport.
3. Registration and Verification of Transporters
  • 3.1. Upon registration, the Transporter is obliged to provide proof of a valid business authorization (license) and a certificate of carrier's liability insurance (cargo insurance).
  • 3.2. The Provider performs basic verification of these documents. However, the Transporter bears sole responsibility for ensuring that these documents are valid at the time of each individual transport.
  • 3.3. The Transporter is obliged to inform the Provider without delay of any change in the validity of their licenses or insurance.
4. Pairing Process and Price
  • 4.1. The Customer submits a request free of charge. The price presented on the Portal is the final price for transport determined by the Transporter or generated based on the Portal's backloading algorithm.
  • 4.2. Payment for transport: The Customer pays the agreed price directly to the Transporter (in cash, by card, or by bank transfer as agreed with the Transporter). The Provider does not accept any payments for transport from the Customer.
  • 4.3. Commission: The service is free of charge for the Customer. The Provider is entitled to a commission from the Transporter for mediating the transaction. The conditions of the commission are governed by a separate agreement between the Provider and the Transporter. The Provider is not a VAT payer; the commission is therefore invoiced without VAT.
5. Liability for Damage
  • 5.1. Liability for the vehicle: The Transporter is exclusively liable for all damage to the transported vehicle, transport delays, or other harm in connection with the transport, in accordance with the relevant legal regulations (CMR Convention, Civil Code).
  • 5.2. Provider's Liability: The Provider is not liable for any damage incurred by the Customer or the Transporter as a result of:
  • — the falsity of data provided by the other contracting party;
  • — non-fulfillment of obligations arising from the Contract for Transport;
  • — temporary unavailability of the Portal.
  • 5.3. The Provider is not liable for any negligence in the selection of the Transporter (culpa in eligendo), provided the Provider proved that standard legal documents were required from the Transporter during registration.
6. Information Obligation and DAC7
  • 6.1. The Transporter acknowledges that the Provider is a "platform operator" within the meaning of the Act on International Cooperation in Tax Administration (implementing the EU DAC7 Directive).
  • 6.2. The Transporter is obliged to provide the Provider with all cooperation and data necessary to fulfill the notification obligation towards the tax authority. In the event of failure to provide this data, the Provider is entitled to block the Transporter's account.
7. Data Protection (GDPR)
  • 7.1. The Provider processes personal data of Customers and Transporters for the purpose of mediating transport.
  • 7.2. The Customer agrees that their contact details (name, telephone, loading/unloading address) will be transferred to the selected Transporter for the purpose of executing the transport. Details are provided in the "Privacy Policy" document.
8. Final Provisions
  • 8.1. These GTC are valid and effective as of 6 June 2026.
  • 8.2. The Provider reserves the right to change the GTC to a reasonable extent. The change will be announced on the Portal at least 15 days before the effective date.
  • 8.3. All disputes arising from the use of the Portal shall be resolved by the court of competent jurisdiction in the Czech Republic. A consumer-Customer has the right to out-of-court settlement of the dispute through the Czech Trade Inspection Authority (www.coi.cz).
